OFCCP Backs Off TRICARE Providers (For Now)

On May 7, 2014 the Office of Federal Contract Compliance Programs (OFCCP) released directive 2014-01. This directive provides a five year moratorium of enforcement activities by the OFCCP for healthcare providers operating under TRICARE. The OFCCP has considered healthcare providers who participate in TRICARE as federal subcontractors and subject to affirmative action requirements and OFCCP jurisdiction. Healthcare providers have felt otherwise.


In light of this “confusion,” the OFCCP is suspending their enforcement activities of TRICARE participants. The OFCCP states in the directive that during this moratorium period they will engage in outreach and offer technical assistance for the TRICARE subcontractor community. While this directive doesn’t really clear up the “confusion” regarding if TRICARE providers are actually federal subcontractors, it does provide a five year reprieve on OFCCP audits.
