This is to remind employers that provide Home Health Care services that the US Department of Labor’s Wage and Hour Division announced a final rule on September 17, 2013 extending the Fair Labor Standards Act’s (FLSA) minimum wage and overtime protections to most of the nation’s direct care workers who provide essential home care assistance to elderly people and people with illnesses, injuries or disabilities. This change, effective January 1, 2015, will require that nearly two million employees – such as home health aides, personal care aides and certified nursing assistants – have the same basic protections already provided to most US employees.

 

This rule will greatly affect those employers who provide Home Health Care services. To assist affected employers in understanding the new requirements, the Department has created a dedicated web portal at http://j.mp/wh-hc with fact sheets, FAQs, interactive web tools and other materials.
