doug for news.jpgOver the past 12 months, CAI received over 8,000 calls from member companies into our Advice and Resolution team.  These calls span the gamut from tactical to operational to strategic HR areas.  However the second most called about issue involved the Family Medical Leave Act (FMLA). 


I guess it should come as no surprise that a new analysis of FMLA data from FMLASource®, a ComPsych® Corporation program, revealed that more than 10 percent of the U.S. workforce is on FMLA leave at any given time. FMLA provides employees with an unpaid leave of absence of up to 12 weeks per year for the birth or adoption of a child, for an employee’s own serious medical condition or for the care of a family member with a serious medical condition. The complexities of FMLA and its frequently changing requirements can pose administrative challenges for employers as well as increased costs and liability risk.


Other trends reported by FMLASource include the following:

  • The average time off on FMLA was two weeks.
  • The top three reasons for leave for an employee’s health condition are (1) surgery, (2) pregnancy and (3) bonding with a new child.
  • The top three reasons for denial of leave are (1) documentation not received in allotted time, (2) requested dates not certified and (3) documentation not received at all.


“While some industries such as health care and call centers have as much as 30 percent of workers on FMLA leave, we still have seen the average number of absences rise across all sectors of the U.S. workforce,” said Dr. Richard A. Chaifetz, Founder, Chairman and CEO of ComPsych. “Employers continue to deal with the complexities of the act and the documentation involved. In the last year alone, there were more than 160 changes to state and federal FMLA regulations, and outsourcing the administration of FMLA has become increasingly attractive to employers as a result.”
